Terms of Service

1. Acceptance of Terms

By accessing or using the Service, you confirm your acceptance of these Terms and agree to be bound by them. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms.

2. Service Overview

AI Pet Portrait lets you upload pet photographs, which are sent to Fal.ai's generative‑AI API to create stylistic pet portraits. Uploads and outputs are stored on Supabase and delivered via our CDN. The platform is hosted on Vercel, uses a Supabase database, and Auth JS for authentication.

3. Eligibility & Accounts

• Age requirement. You must be at least 18 years old to use the Service. We do not permit registration by anyone under 18.
• You agree to provide accurate information, maintain the security of your account, and promptly notify us of any breach.
• One person → one account; shared or transferrable accounts are prohibited.

4. User Content & Intellectual‑Property Rights

You may be able to upload, store, or share content through the Service. You retain all rights in, and are solely responsible for, the user-generated content you post to AI Pet Portrait.

Licence to AI Pet Portrait: You grant us a worldwide, non‑exclusive licence to host, process, display and transmit User Content, and to generate, store and deliver Generated Images for Service operation. You may opt‑in separately if you'd like your uploads used for future model‑training.

Generated Images: To the extent we own or control any rights, we hereby assign to you all our right, title and interest in the Generated Images. You acknowledge that your use of Generated Images must comply with the policies of our AI sub‑processor (currently Fal.ai), and we make no representations or warranties regarding third‑party intellectual‑property claims. We retain a non‑exclusive licence to store copies for debugging, abuse‑detection and legal compliance.

5. Acceptable‑Use Policy

• No illegal, defamatory, pornographic, hateful, or child‑exploitive content.
• No infringement of intellectual‑property or privacy rights.
• No scraping, reverse‑engineering, or overloading of infrastructure.
• No unlawful, deceptive, or discriminatory use of Generated Images.
• No uploading viruses, malware, or other code intended to harm or disrupt the Service.
• Any other conduct that we, in our sole discretion, deem harmful, abusive or disruptive to the Service or its users.

6. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. You understand that AI‑generated content is probabilistic and may contain errors, artifacts or material you find objectionable; we expressly disclaim liability arising from the content or quality of the Generated Images.

• We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non‑infringement.
• We do not guarantee uninterrupted operation or that Generated Images meet your expectations.

7. Copyright Policy

We respect intellectual‑property rights. If you believe that content on the Service infringes your copyright, please email support@aipetportrait.net with the subject line "DMCA Notice" and provide:

• (i) your physical or electronic signature;
• (ii) identification of the copyrighted work;
• (iii) identification of the infringing material (URL);
• (iv) your contact details;
• (v) a statement of good‑faith belief that the use is unauthorised;
• (vi) a statement, under penalty of perjury, that your notice is accurate and you are authorised to act.

We may remove or disable access to the contested content and terminate repeat infringers.

8. Limitation of Liability

To the fullest extent permitted by law, AI Pet Portrait (including its owner, directors, employees and suppliers) shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or reputation, arising out of or related to the Service—even if we have been advised of the possibility of such damages.

Aggregate cap. In no event will our total cumulative liability (whether in contract, tort or otherwise—including for any security incident or data breach) exceed the total amount you actually paid to Petshot Pro for the Service in the 6 months immediately preceding the event giving rise to the claim. If you have not paid any fees, our liability shall not exceed one hundred U.S. dollars (USD $100).

9. Fees, Payments & Refunds

• Prices are shown at checkout and may include applicable taxes.
• Dodo Payments is the Merchant of Record and processes all payments.
• Refunds: If no downloadable portrait is delivered, or quality is materially defective, request a refund within 14 days of purchase. Refunds are at our reasonable discretion.

10. Modifications, Availability & Termination

We may modify features, pricing or these Terms with reasonable notice (email or in‑app). We may, in our sole discretion, suspend or terminate your access to the Service or your account at any time and without notice for any reason, including but not limited to non‑payment of fees, breach of the Acceptable‑Use Policy, or other legal or operational reasons.

11. Indemnification

You agree to indemnify, defend, and hold harmless AI Pet Portrait and its owner from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (i) your User Content; (ii) your use or misuse of the Generated Images; (iii) your breach of these Terms or any applicable law; or (iv) your violation of any third‑party right.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which AI Pet Portrait is located, without regard to its conflict of laws rules. The courts in some countries will not apply these jurisdiction's laws to some types of disputes. If you reside in one of those countries, then where these jurisdiction's laws are required to apply, the laws of your resident country will apply to such disputes related to these Terms.

13. Miscellaneous

• You may not assign or transfer these Terms without our written consent.
• AI Pet Portrait may assign or transfer its rights and obligations under these Terms to an affiliated company or successor in interest.
• We're not liable for force‑majeure events beyond our control.
• Links to third‑party sites are provided "as is"; we are not responsible for their content or practices.
• If any clause is unenforceable, the rest remains in effect.
